GENERAL TERMS AND CONDITIONS – FACED FRONT
Article 1 - Definitions
In these General Terms and Conditions, the following definitions apply:
- Faced Front: The user of these General Terms and Conditions, registered with the Dutch Chamber of Commerce (Kamer van Koophandel).
- Customer: The natural person (consumer) who is not acting in the exercise of a profession or business and who enters into a distance contract with Faced Front.
- Agreement: The distance contract between Faced Front and the Customer for the online purchase and delivery of skincare products via the webshop.
Article 2 - Applicability
- These General Terms and Conditions apply to every offer made by Faced Front and to every Agreement concluded between Faced Front and the Customer.
- Before the Agreement is concluded, the text of these General Terms and Conditions will be made available to the Customer digitally. During the checkout process in the webshop, the Customer must agree to these terms and conditions.
Article 3 - Offer and Prices
- All prices on the Faced Front webshop are stated in Euros (€), including VAT (btw) and excluding any shipping costs, unless stated otherwise. For international orders outside the European Union (such as the US or UK), local import duties, customs fees, and taxes may apply at destination and are the sole responsibility of the Customer.
- Faced Front is not bound by obvious mistakes or errors in the offer, such as an evidently incorrect price display due to a technical glitch.
Article 4 - Minimum Age and Responsibility
- In accordance with the law, minors under the age of 13 may make everyday purchases in our webshop with the presumed consent of their parents or legal guardians.
- Faced Front offers science-backed skincare. The Customer (or their legal representative) is personally responsible for checking whether the ingredients of the ordered products are suitable for the intended user. Faced Front is not liable for damage caused by incorrect use or use on hypersensitive or underaged skin.
Article 5 - Payment and Delivery
- Orders via the webshop are paid for directly online using the payment methods provided (such as iDEAL or credit card).
- Faced Front aims to ship orders as quickly as possible. Stated delivery times are indicative.
- The risk of damage to or loss of products transfers to the Customer at the moment the package is delivered by the postal service to the specified delivery address.
Article 6 - Right of Withdrawal and Forfeiture of Return Guarantee (Returns)
- The Customer has a statutory cooling-off period of 14 days to dissolve the online purchase without giving any reasons. This period begins on the day after receipt of the product by or on behalf of the Customer. (Please note: this statutory cooling-off period strictly applies to consumers within the EU).
- STATUTORY FORFEITURE OF THE RETURN GUARANTEE: In accordance with Article 6:230p sub f of the Dutch Civil Code (Burgerlijk Wetboek), the right of withdrawal (the return guarantee) expires immediately the moment the skincare product is opened after delivery.
- Due to reasons of health protection and hygiene, products of which the security seal, foil, seal sticker, or packaging has been broken or damaged cannot under any circumstances be returned or refunded.
- If the Customer nevertheless returns an opened or used product to Faced Front, no refund will be issued, and the Customer remains the owner of the product. The costs and risks for any return shipment of unopened products are fully borne by the Customer.
Article 7 - Warranty and Complaints
- Faced Front guarantees that the products comply with the Agreement and meet strict European cosmetics safety regulations.
- The Customer must check the delivered products immediately upon receipt. Any defects, damages, or incorrectly delivered products must be reported in writing within 7 days of receipt via information@facedfront.com.
- Faced Front will provide a substantive response to the submitted complaint within 5 working days at the latest.
Article 8 - Limitation of Liability
- The total liability of Faced Front due to a failure to perform the Agreement is at all times limited to a maximum of the invoice amount of the specific order.
- Faced Front is not liable for indirect or emotional damage (such as unexpected individual allergic reactions to ingredients), unless there is intent or deliberate recklessness on the part of Faced Front.
Article 9 - Applicable Law and Disputes
- All legal relationships between Faced Front and the Customer are exclusively governed by Dutch law.
- If a complaint cannot be resolved through mutual consultation via information@facedfront.com, the Customer may submit the dispute to the competent Dutch court.
